Terms & Conditions
This page provides information on the terms and conditions on which we supply all of the products (“Products”) and cooking classes (“Classes”) listed on our websites (www.alycealexandra.com). These terms and conditions also apply to phone orders or direct sales of Products and Classes. ‘We’, ‘us’ and ‘our’ refers to Nikhedonia and Spark Pty Ltd (ACN: 159 480 109) trading as alyce alexandra, registered in Victoria, Australia. alyce alexandra is the registered trademark of Nikhedonia and Spark Pty Ltd. No variation to the below will be held valid unless expressly agreed in writing by us.
1. Sales
a. We will endeavour to deliver your Products within a reasonable time from the date of payment received. Products will usually be despatched within 2 business days of receiving payment, unless Product is temporarily out of stock. Once your order has been despatched by us, delivery time is dependent on our nominated carrier.
b. If an order is erroneously addressed by us, then we will take full responsibility for the re-delivery, replacement or refunding of the Product. If you have provided an incorrect or insufficient address, then we will not refund or resend the product. The full cost for correcting the delivery will be held by you.
c. We provide no guarantee as to the continued availability of any Product and will not be liable to you should any product be out of stock or discontinued at any time.
d. Please inspect all Products received at time of delivery. If you believe Products have been damaged in transit, you must notify us within 48 hours of receipt of goods. If you do not notify us within this time, the Products will be assumed to have been delivered in good condition, waiving any claims of any damage that may have occurred in transit.
e. If a Product is deemed to be damaged or defective, we will replace the Product at no cost to you, providing appropriate notice is given (ref. 1d).
f. All prices on our website, unless otherwise stated, are quoted in Australian Dollars (AUD). These prices include GST (where applicable), and exclude delivery costs which will be calculated based on the weight of your order at checkout.
g. Prices quoted on our website may change at any time, but changes will not affect orders for which payment has already been received.
2. Returns
a. You may return a physical Product within 30 days of purchase for a credit note or refund for the full amount of purchase (less delivery charge), providing the item is returned in its original condition complete with packaging (at your expense). We will inspect the returned product and then issue a credit note or refund within 14 days.
b. Returns will only be accepted through the self-service returns portal. Click here to access.
c. Refunds after 30 days of purchase will only be issued to the extent required by the Trade Practices Act 1974 (Cth) and the respective state Sale of Goods Act legislation.
d. All sales are digital products are final. No refunds or credits are available for digital goods.
3. Privacy
a. We respect your privacy. We use personal information solely to fulfil orders, for feedback purposes, to process transactions or to contact you about our products or services. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail.
b. If you choose to make an account with us you are responsible for maintaining the confidentiality of your password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account.
4. Class bookings
a. Payment in full is required to secure a seat in one of our Classes. Once full payment is received by us, your booking is confirmed and you will receive an automated email verifying this (providing that there is availability).
b. All Class bookings are non-refundable, except in the following instances:
i. Notice is provided in writing of intent to cancel more than 30 days before class start time. In this instance, a full refund will be provided.
ii. Notice is provided in writing of intent to cancel more than 24 hours but less than 30 days before class start time. In this instance, a store credit will be offered of 50% of the ticket price paid.
iii. Cancellations within 24 hours of the class start time will be deemed forfeited and no refund or credit provided.
iv. The above applies to no-shows or cancellations for any reason, including covid-related illness.
c. If, for whatever reason, you are unable to attend our Class, you may send someone in your place.
d. We reserve the right to cancel or reschedule a Class for any reason, including but not limited to; sickness, emergency or low attendance. In the unlikely event that this does occur, all participants will be notified as soon as practicable and will be given the option to book into another class, obtain a store credit or have a full refund provided.
e. Payment via pre-purchased gift voucher is considered payment in full and attracts the same terms and conditions described above.
5. Cooking School
a. We reserve the right to refuse anyone entry into our Cooking School who our staff feel are intoxicated or may cause harm to themselves or anyone else on the premises.
b. When attending our Cooking School, you may be around or using sharp and potentially dangerous tools found in a kitchen. You release, indemnify and exclude us and our employees from any and all liability of any kind for any damage or injury incurred while attending or visiting our Cooking School. That you understand these terms and conditions and accept the inherent risks of a kitchen environment is presumed upon you choosing to enter our facility.
c. We will take all necessary care, but accept no responsibility for the damage to or loss of merchandise left in our facility prior to, during or after a class or event. We are not responsible for the loss or damage of personal items in any form. If you do leave a personal item at our venue, we request you get in contact with us as soon as possible.
d. Any person who attends our venue may be held financially responsible for any damage to or loss of our property due to their inappropriate, careless or negligent behaviour.
e. We are not responsible nor do we give any warranty in respect of any materials, food stuffs or drinks which give rise to any adverse effect or allergic reaction.
f. You may bring a camera into our venue however video is not permitted without prior written consent. We request that you use discretion and consider others’ privacy if taking photographs. We reserve the right to revoke this permission at any time during a class, without notice and at our sole discretion.
g. Persons under the age of 12 must be under direct supervision of an adult guardian at all times.
h. You must acknowledge that we may use your image or likeness in reproductions of class events in advertising and branding, unless you expressly request us not to.
i. Smoking is prohibited in the alyce alexandra cooking school and within 10m of any doorway, window or air intake.
j. You must wear enclosed shoes if participating in cooking classes or working in the alyce alexandra kitchen.
k. “Cooking School” refers to our class venue at 417 City Road, South Melbourne, or any other venue we are using to host our Classes.
6. Reviews
a. At certain points on our website or via email we may ask you to leave feedback and invite you to review our products. By leaving such feedback you give us permission to use, reproduce and publish these comments in a royalty-free, irrevocable manner. You also permit us to publish your first name and State or Town.
b. Reviews posted on our website in no way represent the views or opinions of us, but are the sole product of its creator.
7. Links to other sites
a. Our website may contain links to other websites. We make no representations as to the accuracy of the material therein, and are not responsible for the content and conduct of these sites.
8. General
a. Our website, copy, images, logos, indicia, text and content is subject to copyright. Permission to use documents delivered from our website is restricted. Our name, trademark and logo may not be used without specific, written prior permission from us. The information contained in this website is subject to change without notice.
b. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control.
c. We reserve the right to refuse access to our site, terminate accounts, remove or edit content and cancel orders at our discretion. If we cancel an order, it will be without charge to you. This includes the right to cancel any orders for Products that have been erroneously described and/or priced. We are not responsible for typographical, technical, or descriptive errors.
d. We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
e. The laws of Victoria, Australia govern these terms and conditions and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of Victoria.
9. Recipes
a. Please use our recipes as a guide, not a manual. All cooking entails a certain level of unpredictability and risk, and we cannot possibly account for all of these variables. To protect yourself and others in the kitchen, please exercise caution, and always use our recipes in accordance with the Thermomix safety manual or the safety manual of your machine. For example, never fill your machine above manufacturer’s specifications regardless of recipe.
9. Association
a. 'Thermomix’ is a registered trade mark of Vorwerk International AG (Vorwerk) in Australia and New Zealand and Thermomix in Australia Pty Ltd is its sole authorised distributor in Australia and New Zealand of Thermomix products. Neither Vorwerk nor Thermomix in Australia Pty Ltd sponsors, approves or endorses this website, and alyce alexandra is not affiliated in any way with Vorwerk or Thermomix in Australia Pty Ltd.
